TERMS AND CONDITIONS
The Terms and Conditions (hereinafter Terms and Conditions) include the rights and obligations of Sagío Fashion Kft (hereinafter the Seller or Sagío), operator of the website (https://www.thesagio.com; hereinafter referred to as the website), and the Buyer (hereinafter you or the Buyer), who uses the electronic commercial services provided by the Seller via the Website. The Seller and the Buyer are hereinafter together referred to as the Parties. Shopify International Ltd. (hereinafter webhost) is involved in providing the infrastructure (server and webhosting).
Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to these Terms and Conditions. If you do not agree to all the Terms and Conditions of this agreement, then you may not access the site or use any Services. If these Terms and Conditions constitute an offer, acceptance is expressly limited to these Terms and Conditions.
Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Online store terms
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this website.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms and Conditions will result in an immediate termination of your Services.
3. Goods and services
In the online store, you can purchase women's clothing and accessories sold directly by the Seller. Sagío reserves the right to expand, suspend, or completely discontinue its range of goods and/or services. Sagio is entitled to suspend or refuse to sell goods or provide services if you intend to purchase or use such goods or services in violation of the provisions of the Terms and Conditions.
3.1. Product and pre- order information
Each year, the SAGIO team present two main collections:
- Spring Summer, typically launched in March.
- Fall Winter, generally released in August.
The web shop offers a wide range of ready-to-wear and haute couture pieces. Some limited-edition items may not be available online. If you cannot find a specific item, contact info@thesagio.com and our team will assist you. The Seller offers a dedicated archive section on our website featuring selected pieces from past collections. Some archive items may not be listed online but can still be ordered through customer service at info@thesagio.com. Pre-orders on selected archive pieces may also be available.
4. General provisions
The following Terms and Conditions are valid between you and the Seller and apply to all use of the Seller’s website https://www.thesagio.com/. This Terms and Conditions is in effect 15 January 2024 and shall be effective until withdrawal.
The Seller may modify the Terms and Conditions at any time, informing you in writing at least 30 days before the changes take effect.
The Terms and Conditions in effect at the time of shopping apply to shopping via the website.
The Seller reserves the right, at Seller’s sole discretion, to update, modify or replace any part of this Terms and Conditions by posting updates and changes to the Seller’s website. It is your responsibility to check our website periodically for changes.
If certain parts of our Terms and Conditions are unclear, or if you have any questions, please contact our Customer Service Team via info@thesagio.com before you place any order on our website.
The Terms and Conditions are governed by Hungarian law.
The language of this Terms and Conditions and that of the contractual relation between you and the Seller is the English language. Orders placed via the website are classified as contracts concluded by electronic means and are governed by Act CVIII of 2001 on Electronic Commerce and on Information Society Services. The Seller has not adopted any code of conduct governing its business activities. These Terms and Conditions are not recorded, are only concluded in electronic form, and do not constitute a written contract.
5. The Purchase Process
Please note that purchases can only be made on the website, as we do not receive orders made via phone, emails, or faxes.
Product information (such as photos, delivery dates, prices) on the website is for informative purposes only. Prices displayed on the website are gross prices that include value-added tax, as per the relevant legislation.
You can order and purchase products in our webshop with or without registration. During the registration process, the Buyer is required to provide personal data and accept the Privacy Policy and Terms and Conditions. You shall provide information about yourself that is true, accurate, current and complete in all respects, in the course of registration and purchase. If any of your registration information changes, please notify us immediately by modifying the information in your profile.
Please protect your password and username while The Seller is not liable for damages that occurred due to the fact that your password and/or username could have been available to third parties outside the scope of The Seller’s responsibility.
After registration you can enter our webshop and begin shopping. You can choose the products to be purchased, the colour, the size and the quantity and put the products into your cart.
After placing an order and successfully completing the checkout process, you must be redirected to an order confirmation page and The Seller sends you an order confirmation email without delay, but not later than within forty-eight (48) hours from the time of the order. Usually, this message is shown in the webshop window after the payment method was successfully completed, with the wording “Your order has been confirmed”. The email contains a summary of the order.
To protect the security of our customers and our website, we may cancel your order or ask you to confirm your order. In this case, we will notify you by email. The Seller is not responsible for delayed confirmation if the delay is due to a false or incorrect email address provided by you during registration, or because your email account is unable to receive messages because your inbox is full. This confirmation email does not constitute acceptance of your order but merely confirms that the Seller has received your order.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
6. Payment
The default currency in the webshop is dependent on the selected shipping destination. Purchase prices include value added tax (VAT) in accordance with Hungarian tax rules, but do not include shipping fees. Shipping fees are displayed separately based on your shipping destination. Prices are displayed and charged in the currency of your shipping country. To ensure you see accurate pricing, please select the correct country version of the website via the drop-down menu at the bottom of any page. In case your bank account is in a different currency, then your bank might include some additional exchange. The Seller is not responsible for possible exchange fees in these cases. If you are unsure about the procedures your bank is following in case of such a transaction, we suggest contacting your bank for further information.
The Seller does not support online VAT refunds during the purchase process. If you are shopping as a tourist or for export, please contact your local customs office at the time of departure to complete the necessary paperwork.
If the issuer of your payment card refuses to authorise the payment to the Seller, The Seller shall not be liable for any delay or non-delivery.
The total amount to be paid includes all costs on the basis of your order and the confirmation email. The invoice shall be sent to you in the parcel alongside your purchased item(s).
The Buyer may choose from various payment methods, including online credit card payments (Visa, MasterCard and American Express) and PayPal.
All transactions on the website are secured and compliant with international standards:
- the Seller uses Stripe, a leading payment service provider;
- payments are protected by SSL encryption (Secure Socket Layer), ensuring your personal and financial data remains unreadable to third parties;
- you will see “https” and a padlock icon in your browser’s address bar confirming a secure connection;
- in line with European DSP2 regulations, 3D Secure authentication is applied to all card payments.
If the issuer of your payment card refuses to authorise the payment to the Seller, the Seller shall not be liable for any delay or non-delivery.
The total amount to be paid includes all costs on the basis of your order and the confirmation email. The invoice shall be sent to you in the parcel alongside your purchased item(s).
If you have discount code, you can use this code enter it in the “Promotional Code” field during checkout and click Apply. The discount will be reflected in your total before payment. If the code does not work, verify that it is entered correctly, has not expired, and meets the promotion requirements. For further assistance, contact info@thesagio.com.
7. Delivery and Shipping
The delivery of the products is made by the Seller worldwide through the courier services of DHL

8. Right of withdrawal
You can announce your right of withdrawal within fourteen (14) days of receiving your original order without reasoning. You announce such right in an expressed statement sent to the Client Service Team (info@thesagio.com) within the above fourteen (14) day deadline, as regulated by Government Decree 45/2014 (II.26.) on contracts between consumers and businesses. You shall send back the item to us without delay, but within the initial fourteen (14) days upon delivery. If your order is not applicable for a free return label, then make sure to keep the proof of mailing of the parcel. The deadlines above shall be regarded as being complied with if you send your statement or the item before the fourteen (14) days have expired.
The Seller will refund the price of the returned product after we have received it. The Seller will refund such shipping fee, which was chosen by you. The refund shall be made in the same way as the original method of your payment was made.
You will receive a written notification via email that we have received your returned item. Any item returned
exceeding the fourteen (14) day deadline will not be eligible for a refund and will be shipped back to the sender. You are not entitled to exercise the right of withdrawal when the item was prepared especially upon your own instructions, or on your expressed demand, or in case the item was unambiguously personalized to you.
9. Liability for products
Please note, that the Seller is not liable for damages resulting from natural amortization, defect or negligent use, abnormal consumption or misuse or any other treatment that is not suited to the product description.
The Seller provides warranty in accordance with the applicable regulations, including the Act V of 2013 of the Hungarian Civil Code (hereinafter referred to as Civil Code) and Government Decree 151/2003 (IX.22.).
Please note that the provisions in this section apply only to consumers. A consumer is defined as a private individual who is not engaged in professional or business activities. Non-consumer purchasers are subject to the different provisions of Civil Code.
9.1. Liability for defective items
In the event of defective performance, you are entitled to make a claim against us for defective products in accordance with Civil Code.
Upon your request, you are entitled to make the following claims:
- if an item is defective due to a manufacturing fault, we will offer to repair the item or exchange it;
- if it cannot be repaired or the same item is not available, you are entitled to a proportional price reduction or to a full refund (i.e. the purchase price along with the shipping fee).
You are entitled to modify your chosen claim, but you are responsible for the costs imposed by this modification, except it was caused by us. You shall inform us about the defect without delay, but within two (2) months from the date of its discovery at the latest.
You are entitled to make a claim against us within two (2) years from the date of delivery.
9.2. Liability for defective products
If you are purchasing as a private individual, you also have the right to complain to the Seller about defective products as described in section 9.1. However, please note that under Hungarian law you must choose between your rights described in sections 9.1 and 9.2, i.e. you can only make a claim against the Seller defective items or defective products You are not entitled to make a claim under both points.
If a product is defective, you can only choose to have it repaired by us or request a replacement for the product. You must notify us of the defect immediately, but no later than two (2) months from the date of discovery of the defect. In the case of a defective product, you are required to demonstrate the defect in the product. A product is only considered defective if (i) it does not meet the quality requirements prescribed by law, or (ii) it does not have the characteristics specified in the description of the product we delivered.
You are entitled to make a claim against us within two (2) years from the date of delivery.
10. The complaint process
The Seller shall strive to resolve all complaints amicably, through negotiation or other peaceful means.
You can submit your complaint verbally at any of our stores, in writing to our address, or virtually via email.
The Seller will immediately investigate any verbal complaints and resolve them if necessary. If you are not satisfied with the outcome or immediate resolution is not possible, we will prepare a report. The Seller will respond to all written complaints in writing within thirty (30) days of receipt. If The seller does not accept your complaint, they will provide you with a reason. 11. Intellectual property rights
Any invention, discovery, development, design, idea, creation, software, technology, procedure, process, technical material, documentation (hereinafter intellectual properties) relating to the products and services of the Seller in any manner are subject to copyright protection, and all or parts of them are the exclusive property of the Seller.
It is prohibited to download, electronically store, process, or transmit the intellectual property products found on the website or in the web shop, in whole or in part, without the prior written consent of the Seller. The Seller reserves the right to take the necessary legal action against infringing parties in the event of a violation.
12. Miscellaneous
If the Seller does not exercise or strictly enforce its rights under these Terms and Conditions or other guidelines or legal provisions, such failure to exercise such rights shall not be deemed a waiver of such rights. Any waiver of rights must be made in writing.
The Seller makes no promises regarding the goods other than those contained in these Terms and Conditions and expressly disclaims any liability for the content, operation, reliability, availability, and suitability of the goods and services for your needs.
The Seller excludes all warranties to the extent permitted by law.
The Seller shall in no event be liable for any reasonably unforeseeable losses or damages.
If any provision of these Terms and Conditions becomes invalid, illegal, or unenforceable, the remaining provisions of these Terms and Conditions shall remain in full force and effect.
13. Optional Tools
The Seller may provide you with access to tools developed by third parties that we do not control, supervise, or influence.
You acknowledge and agree that access to such tools is provided "as is" and "as available," without any warranties, representations, or conditions of any kind and without any endorsement. The Seller assumes no responsibility for the use of or connection to any optional third-party tools.
The use of any optional tools offered through the website is entirely at your own risk and discretion, and you should ensure that you are familiar with and accept the terms and conditions of the third-party provider(s) of the tools.
The Seller may also offer new services and/or features through the website in the future (including the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.
